1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern the use of the website and digital store operated by 821SCENT S.L. (“821SCENT,” “we,” “us,” or “our”), accessible at www.821scent.com.
By accessing our website, registering for our digital sampling program, purchasing products, or subscribing to our refill service, you acknowledge and agree to comply with these Terms of Service, our Privacy Policy, and any additional policies referenced therein.
821SCENT is a European direct-to-consumer luxury scent house offering diffusion devices, natural and aromatic essential oil blends, and refillable scent capsules. By using the Site, you confirm that you are at least 18 years old (or the legal age of majority in your country of residence) and capable of entering into a binding agreement.

2. Personal Data and Consent

By placing an order, joining our subscription program, or requesting a digital sampling box, you consent to the processing of your personal data in accordance with the GDPR, the Spanish LOPDGDD, and our Privacy Policy.
Personal data collected may include your name, address, email, billing details, order information, and communication history.
This data is processed exclusively for order fulfilment, subscription management, customer support, and compliance with EU legal obligations.
You may request access, correction, deletion, or withdrawal of consent by contacting privacy@821scent.com.

3. Subscription and Refill Program

The 821SCENT Refill Program provides recurring deliveries of 50 ml scent capsules formulated with natural and aromatic essential oils.
”Subscribers may cancel their subscription at any time by providing three months’ written notice to support@821scent.com or through the official website chat.
Cancellation becomes effective once acknowledged by 821SCENT. Any shipments billed or prepared during the notice period will still be fulfilled.
821SCENT may modify or pause refill schedules for operational, regulatory, or supply-related reasons, with advance notice to customers.

4. Authorized Sales Channels

821SCENT products may be purchased exclusively through www.821scent.com and verified digital integrations such as Instagram and TikTok Shops.
821SCENT S.L. remains the legal seller and data controller. Unauthorized resellers or marketplaces are not approved, and products purchased outside official channels are not covered by warranties or customer care.

5. Digital Sampling Program

The 821SCENT Digital Sampling Box provides customers with five 1.5 ml vials of signature fragrances.
By registering, you consent to the collection of personal data for shipment and communication purposes. Sampling is subject to availability.

6. Orders, Pricing, and Shipping

Submitting an order constitutes an offer to purchase. 821SCENT may accept or decline orders based on stock availability or regulatory considerations.
All prices are shown in EUR, inclusive of VAT.
We ship to Spain, France, Germany, Belgium, and the Netherlands, with additional destinations available depending on regulatory compliance.
For deliveries outside certified EU countries, customs duties and import taxes are the customer’s responsibility. 821SCENT provides documentation to assist with customs procedures.
Payments are processed securely via authorized gateways.

7. Returns, Withdrawal Rights, and Legal Guarantee

EU/EEA consumers have a 14-day right of withdrawal from receipt of goods. Refunds include the product price and standard outbound shipping.

All diffusers and electrical devices include a two-year legal conformity guarantee under EU law, covering repair, replacement, or refund for defective goods.

8. Product Safety, Composition, and Use Policy

All 821SCENT oils and diffusers comply with REACH, CLP, IFRA, and CE standards.
821SCENT oils and capsules are designed exclusively for home scent diffusion with 821SCENT cold-air diffusers. They must not be applied to the body, mixed with other liquids, heated, used with other devices, or ingested.
Ingestion of fragrance oils may be harmful. Keep oils out of reach of children and pets. Seek medical assistance in case of accidental ingestion.
Using third-party oils may damage devices and void warranties and return eligibility.
821SCENT is not liable for misuse or allergic reactions.

9. Intellectual Property

All trademarks, designs, packaging, and content under 821SCENT are the intellectual property of 821SCENT S.L. No reproduction or modification is permitted without written consent.

10. Limitation of Liability

821SCENT is not liable for damages arising from misuse, modification, or unauthorized resale of products. Our liability shall not exceed the purchase price of the product involved.

11. Force Majeure

821SCENT is not responsible for delays due to events beyond reasonable control, including natural disasters, logistics disruptions, regulatory delays, or public health emergencies.

12. Governing Law and Jurisdiction

For consumers residing in Spain, France, Belgium, the Netherlands, or Germany, these Terms are governed by the laws of their country of residence. For all other customers, Spanish law applies, with jurisdiction in the Courts of Barcelona.
Consumers may also use the EU Online Dispute Resolution (ODR) platform.

13. Regulatory and Compliance Declaration

821SCENT complies with EU regulations related to WEEE, Packaging EPR, REACH, CLP, IFRA, and CE safety requirements.
Valid registrations are held in Spain, France, Belgium, Germany, and the Netherlands.
