. By accessing our site, registering for sampling, or purchasing from us, you agree to these terms of service (“terms”), our privacy policy, and any policies referenced herein.

821scent operates as a direct-to-consumer luxury scent company, offering scent diffusers, a blend of natural and aromatic essential oils, and refillable scent capsules through official online platforms only. By using this site, you confirm that you are at least 18 years of age (or the legal age of majority in your country) and capable of entering into a binding agreement.

1. CONSENT AND DATA HANDLING

By placing an order, registering for digital sampling, or joining our refill subscription, you give explicit consent for 821scent S.L. to collect, process, and securely store your personal data in accordance with the general data protection regulation (GDPR) and our privacy policy. Personal data includes your name, contact details, address, and communication history shared through our website, chat, or email. This information is used exclusively to: fulfill and deliver orders or sampling requests; manage subscriptions and refills; and maintain communication and customer support. You may withdraw consent or request access, correction, or deletion at any time by contacting privacy@821scent.com.

2. SUBSCRIPTION AND REFILL PROGRAM

The 821scent refill program provides recurring deliveries of 50 ml scent capsules, allowing customers to enjoy continuous scent experiences in their chosen blend of natural and aromatic essential oils.
Customers may cancel their subscription at any time by providing a three-month written notice, sent by email to support@821scent.com or through our official website chat.
The cancellation notice takes effect from the date it is received and confirmed by 821scent.
Shipments already billed or prepared within that period will still be fulfilled as part of the final cycle.
821scent reserves the right to modify or pause refill schedules for operational, compliance, or supply reasons, with prior notice to subscribers.

3. DIRECT-TO-CONSUMER SALES CHANNELS

821scent operates exclusively as a direct-to-consumer brand, with all purchases made directly through www.821scent.com
Our online store is powered by the Shopify e-commerce platform, which provides secure checkout, payments, and order management. Shopify acts solely as a technology provider 821scent S.L. remains the legal seller, data controller, and contracting party under european law.
Consumers may also purchase through verified digital integrations, such as instagram or tiktok shops, which are directly connected to our website’s secure checkout.
We do not sell through physical retail stores, resellers, or unauthorized third-party marketplaces. Products obtained outside these official channels are not covered by 821scent’s warranties, legal guarantees, or customer care.

4. DIGITAL SAMPLING PROGRAM

The 821scent digital sampling box introduces customers to all five signature scents in 1.5 ml vials. By registering, you consent to provide your personal information for shipment and communication purposes in compliance with GDPR. Sampling requests are processed promptly, subject to availability, and may include early access to pre-orders before public launch.

5. ORDERS, PAYMENTS, AND SHIPPING

All prices are shown in eur, inclusive of vat for eu customers.
We ship to Belgium, the Netherlands, France, Germany, and Spain (where 821scent holds full weee and EPR Certifications); other EU countries; and International destinations including the United Kingdom, Switzerland, and the United States.
For all destinations outside the certified eu countries and for non-eu countries, customs duties, import taxes, and any additional documentation required for entry are the responsibility of the customer. 821scent will provide supporting documentation such as invoices, product safety certificates, and regulatory declarations to facilitate customs clearance when needed.
Payments are processed securely via authorized gateways.
Accepted methods include major credit/debit cards, and other options displayed at checkout.

6. RETURNS, WITHDRAWAL, AND LEGAL GUARANTEE

EU/EEA consumers have a 14-day right of withdrawal from receipt of goods, without giving any reason. Refunds include the product cost and standard outbound shipping charges.
Exceptions: opened or unsealed scent oils (for hygiene reasons) and used devices unless defective or misdescribed upon delivery.
All 821scent diffusers and electrical devices are covered by the two-year legal conformity guarantee under EU consumer protection law. Within two years of purchase, customers are entitled to repair, replacement, or refund if a product is defective or does not match its description.

7. PRODUCT SAFETY AND COMPOSITION

All 821scent oils and diffusers are designed for safe, modern, cold-air diffusion and comply with European and international safety standards.
Each oil is composed of a blend of natural and aromatic essential oils; vegan and cruelty-free; free from solvents, petroleum derivatives, and parabens; formulated exclusively for cold-air diffusion (no heat / no water). All formulations comply with reach, CLP, and IFRA standards, and all diffusers are CE-marked.

Use and compatibility disclaimer:

All 821scent oils are designed exclusively for home and interior scent diffusion using 821scent diffusers. They are not cosmetic products and must not be applied to the skin, hair, or body, nor used in humidifiers, candles, or any other heating or mixing devices. Using third-party or non-821scent oils may affect performance or cause damage to the diffuser system and therefore voids any warranty, return, or refund eligibility. 821scent s.l. shall not be held liable for any allergic reactions, misuse, or damage resulting from improper use or the use of unauthorized products.

8. INTELLECTUAL PROPERTY

All trademarks, names, designs, photographs, and text under 821scent are the intellectual property of 821scent S.L. and protected under EU and international law. No reproduction, resale, or modification is permitted without prior written authorization.

9. LIMITATION OF LIABILITY

821scent shall not be liable for damage or loss arising from misuse, modification, or unauthorized resale of products. We are not responsible for warranties, representations, or policies made by third parties. To the extent permitted by law, our total liability shall not exceed the purchase price paid for the product involved.

10. FORCE MAJEURE

821scent shall not be held liable for any delay, failure, or non-performance due to circumstances beyond its reasonable control, including natural disasters, labor strikes, pandemics, logistics disruptions, or regulatory actions.

11. GOVERNING LAW AND JURISDICTION

For consumers residing in Belgium, the Netherlands, France, Spain, or Germany, these terms are governed by the laws of your country of residence, and disputes may be brought before local courts. For all other users and business clients, these terms are governed by Spanish law, with jurisdiction in the courts of Barcelona, Spain. Consumers may also use the EU online dispute resolution (ODR) platform for cross-border complaints.

12. REGULATORY & COMPLIANCE STATEMENT

821scent S.L. complies with all applicable EU and international laws governing home fragrance, electronic diffusion systems, and packaging sustainability. We hold valid WEEE and packaging EPR certificates in Belgium, the Netherlands, France, Germany, and Spain. Our fragrance oils conform to reach, CLP, and IFRA standards, and our diffusers meet CE requirements.
Shipping outside these certified EU countries including to other EU states, the United Kingdom, Switzerland, and the United States is available. While customs duties, local taxes, and compliance paperwork remain the responsibility of the customer, 821scent will provide all relevant documentation (certificates, SDS, invoices) to facilitate customs clearance.
